MyStore18.com is an online marketplace and an intermediary that (a) provides a platform for Users (who are sellers) to advertise, exhibit, make available and offer to sell various Products to other Users (who are buyers / customers), and (b) a platform for such other Users to accept the offer to sell of the Products made by the sellers on the Website and to make payments to the sellers for purchase of the Products, and (c) services to facilitate the engagement of buyers and sellers to under commerce on the Website, and (d) such other services as are incidental and ancillary thereto. The Services are offered to the Users through various modes which may include issue of coupons and vouchers that can be redeemed for various Products.

We reserve the right to refuse service to anyone for any reason at any time.

You shall not have more than one active Account (defined hereunder) on the Website. Additionally, You are prohibited from selling, trading, or otherwise transferring Your Account to another person.

MyStore18.com may cancel or terminate a User’s account if MyStore18.com has reasons to suspect that the User has concurrently registered or controlled two or more accounts. Further, MyStore18.com may reject User’s application, without assigning any reasons thereof, for registration for any other reason.

User consents to the inclusion of the contact information about User in MyStore18.com’s database.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

MyStore18.com does not control and is not liable to or responsible for the quality, safety, lawfulness or availability of the products or services offered for sale on the Platform or the ability of the sellers to complete a sale or the ability of buyers to complete a purchase.

Users agree that MyStore18.com cannot and does not confirm each User’s purported identity. MyStore18.com encourage Users to exercise discretion and caution while dealing with various Users.

The Estimate Delivery/Shipping Time of any product is just for reference only, actual delivery time may vary, depends on situations(including without limitation, the non-availability of products, Internet failures, computer, telecommunications or any other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, flood, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals or non-performance of third parties).

MyStore18.com accepts no liability for any errors or omissions, whether on behalf of itself or third parties.

MyStore18.com does not at any point of time during any transaction between buyer and seller on the Platform come into or take possession of any of the products or services offered by seller nor does it at any point gain title to or have any rights or claims over the products or services offered by seller to buyer.

In the event that any User has a dispute with any party to a transaction, such User agrees to release and indemnify MyStore18.com (and our agents, affiliates, directors, officers and employees) from all claims, demands, actions, proceedings, costs, expenses and damages (including without limitation any actual, special, incidental or consequential damages) arising out of or in connection with such transaction. This clause shall also apply to any additional services opted for by the User by accessing any link from MyStore18.com site to avail of services related to the transaction of buy-sell conducted on the MyStore18.com Platform.

-  Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES PROVIDED BY MyStore18.com ON OR THROUGH THE PLATFORM ARE PROVIDED “AS IS”, “AS AVAILABLE” AND “WITH ALL FAULTS”, AND MyStore18.com HEREBY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY WARRANTIES OF CONDITION, QUALITY, DURABILITY, PERFORMANCE, ACCURACY, RELIABILITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. -  Payments related Information

MyStore18.com may charge Users certain fees for the use of the Website and Services as a whole, or certain features of the Website / Services. You agree to pay any such fees, as may be applicable to the Services that You use. MyStore18.com will try to ensure that You are made aware of the applicability of any fees for a particular use of the Website / Services, as well as the amount of fees payable by You for any such use of the Website / Service. You agree that MyStore18.com may, at any time, charge, modify or waive fees required to use the Website. You shall not use the credit/debit card or pre-paid payment instrument or net banking details or UPI ID which is not lawfully owned by You, i.e. in any transaction, You must use Your own credit/debit card or pre-paid instrument account or net banking account or UPI ID. The information provided by You will not be utilized or shared with any third party unless required in relation to fraud verifications or by law, regulation or court order or in accordance with the terms of the Privacy Policy. You will be solely responsible for the security and confidentiality of Your credit/debit card details or pre-paid instrument account or net banking details or UPI ID. MyStore18.com expressly disclaims all liabilities that may arise as a consequence of any unauthorized use of Your credit/ debit card or pre-paid instrument account.

You are not permitted to use the Marks without the prior consent of MyStore18.com, the vendor/seller or the third party that may own the Marks.

- IP Infringement

- Third Party Content

General third party information such as, product catalogues, product description and specifications, lists of dealers, reports on news, entertainment, technology and features, advertisements including videos, images and photographs of the products, links to third party websites and other data from external sources is made available on the Website ("Third Party Content"). The provision of Third Party Content is for general informational purposes only. You acknowledge that the Third Party Content provided to You is obtained from sources believed to be reliable or provided by the sellers in the process of advertising, exhibiting and offering to sell the Products on the Website. All Third Party Content is provided on an 'As Is' basis. MyStore18.com may not own / have the rights and title to any such Third Party Content, or provide any guarantee with respect to the accuracy, title, merchantability, non-infringement or fitness for a particular purpose of any Third Party Content. MyStore18.com shall not be held liable for any loss suffered by You based on Your reliance on or use of such Third Party Content.

- Liquidation Stock Products Policy

We Buy Liquidated Stock lots from various sources/suppliers of larger quantity items and All the liquidation stock contains mixed product items. First We buy large quantity Liquidation stock lot and then We split up the lot of inventory into smaller lots(according to box size or items weight), make Packages of random items to appeal to a larger pool of buyers. Quantity of Package items depends on Lot split quantity calculations(by size or weight) and can vary from Lot to Lot. Worth of Bundle Items depends on products types/quantity and can vary from lot to lot. MyStore18.com does not guarantee/promise of how much worth of Package items you will get. You may get any Worth of Package items(Less than or more than or equal to buying price). Some Liquidation stock lot may contain some used, broken or not in working condition product items and MyStore18.com will not be liable for any loss arising from the purchase of liquidated stock lot items.

- General Provisions

Subject to any terms & conditions, the Terms constitute the entire agreement between User and MyStore18.com with respect to and govern User’s use of the Platform and Services, superseding any prior written or oral agreements in relation to the same subject matter herein.

MyStore18.com and User are independent contractors, and no agency, partnership, joint venture, employee-employer relationship is intended or created by the Terms.

If any provision of the Terms is held to be invalid or unenforceable, such provision shall be deleted and the remaining provisions shall remain valid and be enforced.

MyStore18.com’s failure to enforce any right or failure to act with respect to any breach by User under the Terms will not constitute a waiver of that right nor a waiver of MyStore18.com’s right to act with respect to subsequent or similar breaches.

MyStore18.com shall have the right to assign the Terms (including all of our rights, titles, benefits, interests, and obligations and duties in the Terms to any person or entity (including any affiliates of MyStore18.com). User may not assign, in whole or part, the Terms to any person or entity.
